Controversial hiplife artiste, Kwaw Kese, known in real life as Emmanuel Botchway has for the third time been denied bail.
The rapper after two failed attempts to get bail at the Kumasi Metropolitan Assembly (KMA) Circuit Court, took his case to the Kumasi High Court Friday hoping to secure bail.
He was hoping to get a favourable hearing from the higher court after the Circuit Court denied him bail on the grounds that the use of narcotics is a non-bailable offence.
But the High Court followed the example of the circuit court and refused the musician bail.
Luv FM’s Erastus Asare Donkor reported that at Friday’s hearing, presided over by Justice PKB Apenkwa, the rapper’s lawyer argued that Kwaw Kese is being held for an unduly long time over a simple suspicion because the results of the substance which they claim is cannabis has not been obtained.
But the prosecution counted his argument, insisting they have the results of the test and are ready to go on with the trial.
The prosecution further argued that per the amendment of the criminal code, the musician cannot be granted bail. The prosecution’s argument was upheld by the judge who urged that the process be sped up.
Erastus revealed that Kwaw Kese looked very sad in court. His sullen, sunken face brightened when he was informed that there are mitigated sentences in which Kwaw Kese could spend just a day in jail and a fine.
But there are certain conditions which he must satisfy.
Kwaw Kese is currently on remand at the Kumasi Central Prison.
The controversial rapper was arrested by the police in Kumasi on Saturday, November 22 for allegedly smoking cannabis in public.
He is to reappear on December 22.
