KKD given a week’s bed rest

KKD-ghana-radio-presenterThe Kaneshie District Magistrate Court in Accra for the second time yesterday could not continue with the committal trial of embattled showbiz icon Kwasi Kyei Darkwah aka KKD.

KKD, according to his lawyers, was sick and so was unable to attend court proceedings.

Susana Nyarko, who was holding brief for counsel for KKD, Anthony Forson, further told the court that the accused person was going to see a clinical psychologist because he was not in a good frame of mind.

She said this was recommended after KKD’s medical review on Wednesday.

Ms Nyarko, per the medical report, stated that KKD had been given a week’s bed rest.

The medical report was produced by the lawyer to authenticate the claim of KKD’s poor state of health.
However, the state prosecutor, Cynthia Lamptey, was furious over the fact that she was not given a copy of the medical report before the hearing.
It may be recalled that Ms Lamptey, the Director of Public Prosecutions, at the last adjourned date, raised some reservations about the absence of KKD at the trial.

She argued that he was technically absent and “would have asked for a bench warrant” for his arrest.

Ms Lamptey said it was wrong for counsel for KKD, Anthony Forson, to verbally tell the court that his client was sick and had been admitted at the Korle-Bu Teaching Hospital without producing any medical report to that effect.

The trial judge, Mrs Adwoa Akyaamaa Ofosu, accordingly adjourned the case to February 18, 2015.

 

KKD has been arraigned before the court for allegedly raping one Ewuraffe Orleans Thompson, 19-year-old student, in a bathroom at the African Regent Hotel, Accra, on December 27 last year.

He is said to have had carnal knowledge of the victim without her consent at the bathroom of the hotel, even though KKD claimed that it was consensual sex.

It is not clear whether he used condom for the consensual sex he described as ‘fleeting pleasure’ with Ewuraffe.

Even though the 19-year-old lady says she wants to discontinue the case and the accused has also apologised to the lady publicly, state prosecutors are bent on pursuing the case further.
KKD was consequently granted bail by a

Human Rights Court on humanitarian grounds in the sum of GH¢20,000 with two sureties after he had been on remand at the Airport Police Station for the offence.

The court granted the bail because counsel for the accused person filed a supplementary affidavit on January 6 and further affidavits on January 8, 2015, supported by a medical report.
