The immediate past Managing Director of the Bulk Oil Storage and Transportation (BOST) Company Limited, Mr Kingsley Kwame Awuah-Darko, has sued the Member of Parliament for Assin Central, Mr Kennedy Ohene Agyapong for some statements Mr Awuah-Darko said were defamatory against him.
The suit, filed on his behalf by Dr Dominic Akuritinga Ayine, at the Accra High Court also cited owners of two radio stations, namely Asempa FM of the Multimedia Group Limited (MGL) and Oman FM of the Kencity Group, owned by the MP.
Mr Awuah-Darko is demanding GHc5 million in damages from Mr Agyapong.
According to Mr Awuah-Darko, Mr Agyapong had on June 29, 2017 on the Asempa FM Ekosii Sen programme accused him of misappropriating some $100 million when he served as MD of BOST from 2013 to January 2017.
Mr Agyapong, the plaintiff said, repeated the claims on Oman FM’s Boiling Point programme, thereby impugning criminal conduct including stealing of public funds, misappropriation of public funds, defrauding the state, corruption and the crime of causing financial loss to the state against his person.
The said the defamatory remarks, he said were passed “with malice and with the sole intent of reducing him in the estimation of all right-thinking members of society as a corrupt and dishonest former public official.”
Mr Awuah-Darko, apart from the damages he is seeking is also praying the court to restrain them from further publishing any defamatory words against his person.
He is also praying the court to direct the defendants to publish an unqualified retraction and an apology with same prominence within 14 days after the judgement.
