KKD’s alleged rape case moved to high court

KKD-with-Nana-Asante1Lawyers for Kwesi Kyei Darkwah (alias KKD) have rolled up their sleeves in readiness for the trial of the rape case against the ace broadcaster at the High Court.

The district magistrate’s court early today heard arguments from both parties, as it tied up the final ends of the case before it moves on to the higher court.

Anny Osabutey who was in court, reports that the decision was taken after submissions from KKD’s lawyers, based on the statement of facts and a bill of indictment.

KKD is being tried for allegedly raping a 19-year-old lady in December last year.

According to Anny, counsel for the embattled broadcaster, Tony Forson questioned how the state prosecutors would prosecute the matter, especially as the key witness; the victim Ewuraffe Orleans Thompson has refused to cooperate.

In such trials, the presence of a credible witness plays a major role in the prosecution.

He gave the example of a case involving former IMF boss Dominique Strauss-Khan, who faced similar charges of rape in 2011. The prosecution dropped the charges after they determined the alleged victim would not be a credible witness following a string of contradictions on her part.

Despite all arguments, the state insists it has all it requires and is going ahead with a full trial.

Tony Forson said that it seemed that the state instead of prosecuting is rather persecuting his client. According to him, a lawyer’s duty is to assist the court determine a matter quickly but the contrary is happening in this case.

The case will be called at the Accra High Court on the 18th of March, 2015.
