Nigerian held over defilement acquitted

It was all joy when an Accra Circuit Court acquitted and discharged Godlove Livinus, a Nigerian who was accused of defiling a 13 year old girl, at a vegetable farm at Airport.

Livinus, who shed tears of joy, continuously thanked the Trial Judge for acquitting him.

His mother also broke down in tears after hearing that his son had been acquitted. Livinus and the mother embraced each other amidst tears in the courtroom.

Livinus, a 29 year old labourer, had pleaded not guilty to the charge of defilement.

The court presided over by Mrs Abena Oppong Adjin-Doku found him not guilty, citing inconsistencies in the evidence of witnesses.

Prosecuting Chief Inspector Kofi Atimbire said the complainant is a food vendor residing at Legion Village, near Opeibea house, Airport.   

The victim, a Junior High School form One pupil, resides with her mother, who is also the complainant in the matter.

The case as presented by the police is that, Livinus is a neighbour to the complainant. On November 11, last year, at about 2100 hours Livinus lured the victim to a vegetable farm near the Legion Village and had sex with her.

A witness who saw the incident raised an alarm and people were attracted to the scene.

Prosecution said Livinus was handed over to a Police Patrol Team who in turn handed him over to the Domestic Violence and Victim’s Support Unit at Airport.

The victim was issued with a medical form and she was examined by a medical practitioner.

In another development, the same court has also acquitted and discharged Michael Nii Armah, a taxi driver, who was accused of sexually assaulting a minor at Awoshie.

Nii Armah was facing a charge of indecent assault. The court at the end of the trial found Nii Armah not guilty.
